These Artist Terms & Conditions (“Agreement”) govern the relationship between ShowMaker Enterprise (“Showmaker”, “we”, “our”, “us”) and the Artist, Performer, Speaker, Host, Facilitator, Agency, Manager, Production Partner, or Talent Representative (“Artist”, “you”, “your”).
This Agreement applies to participation in the Showmaker artist directory, talent marketplace, proposals, corporate event opportunities, and related services operated through www.showmaker.in.
By submitting a profile, media kit, portfolio, photographs, videos, showreels, performance information, or any other materials to Showmaker, you agree to these Terms & Conditions.
Section 1About this agreement
These Artist Terms & Conditions (“Agreement”) govern the relationship between:
ShowMaker Enterprise (“Showmaker”, “we”, “our”, “us”)
and
the Artist, Performer, Speaker, Host, Facilitator, Agency, Manager, Production Partner, or Talent Representative (“Artist”, “you”, “your”).
This Agreement applies to participation in the Showmaker artist directory, talent marketplace, proposals, corporate event opportunities, and related services operated through www.showmaker.in.
By submitting a profile, media kit, portfolio, photographs, videos, showreels, performance information, or any other materials to Showmaker, you agree to these Terms & Conditions.
Section 2Artist registration
Artists may register directly or through an authorised representative, manager, agency, or production company.
All information provided must be:
- Accurate
- Complete
- Current
- Non-misleading
This includes:
- Artist biography
- Experience
- Performance category
- Fee expectations
- Technical requirements
- Travel limitations
- Availability information
Showmaker reserves the right to:
- Approve profiles
- Reject applications
- Request additional information
- Suspend listings
- Remove listings
without obligation to provide detailed reasons.
Section 3Content submission & profile materials
Artists may provide:
- Photographs
- Videos
- Showreels
- Biographies
- Technical riders
- Performance descriptions
- Social media links
- Promotional assets
Showmaker may review and edit profile content for:
- Formatting
- Clarity
- Consistency
- Corporate suitability
Any editorial adjustments shall not transfer ownership of the content to Showmaker.
Section 4Content ownership & licence
Artists retain ownership of all submitted content, including:
- Images
- Videos
- Audio recordings
- Biographies
- Promotional materials
By submitting content, the Artist grants Showmaker a non-exclusive, royalty-free, worldwide licence to:
- Host
- Display
- Publish
- Promote
- Reproduce
such content solely for:
- Artist promotion
- Corporate proposals
- Marketing activities
- Talent discovery
- Platform operations
Showmaker shall not sell or commercially exploit artist content outside these purposes without additional consent.
Section 5Directory listing & visibility
Approved profiles may appear on:
- Artist directory pages
- Category pages
- Location pages
- Event proposals
- Talent recommendations
- Marketing materials
Showmaker does not guarantee:
- Website traffic
- Profile views
- Enquiries
- Bookings
- Revenue
Profile placement and visibility may vary based on platform requirements, content quality, category relevance, and user activity.
Section 6Enquiries & booking process
When a client expresses interest in an Artist, Showmaker may contact the Artist or their representative to:
- Confirm availability
- Verify requirements
- Discuss commercial terms
- Review logistics
Artists remain free to:
- Accept opportunities
- Decline opportunities
- Negotiate specific requirements
A booking shall be considered confirmed only after:
- Written confirmation
- Commercial agreement
- Required approvals
- Advance payment requirements (where applicable)
are completed.
Showmaker does not guarantee any booking opportunity.
Section 7Direct client engagement & circumvention
Where a client, lead, opportunity, enquiry, proposal, or booking is introduced through Showmaker, the Artist agrees not to intentionally bypass Showmaker in order to directly contract with the client for the same engagement or a substantially related engagement introduced through Showmaker.
Commercial discussions regarding opportunities generated by Showmaker should be routed through Showmaker unless otherwise agreed in writing.
This provision protects the business development, marketing, sales, and client acquisition efforts undertaken by Showmaker.
Section 8Commercial terms & payments
Artist fees, logistics costs, travel expenses, accommodation requirements, technical requirements, and performance fees shall be agreed on a project-by-project basis.
Showmaker may:
- Collect payment from clients
- Coordinate payments
- Manage commercial discussions
- Facilitate booking administration
Payment timelines may vary depending on:
- Client payment schedules
- Procurement processes
- Event completion
- Contractual obligations
Showmaker shall not be responsible for payment delays caused by clients, force majeure events, banking delays, or circumstances beyond its reasonable control.
Section 9Profile accuracy & professional standards
Artists agree to maintain accurate information regarding:
- Experience
- Repertoire
- Technical requirements
- Availability
- Contact information
- Fee expectations
Artists are expected to maintain professional standards when engaging with clients introduced by Showmaker.
Showmaker may suspend or remove profiles where an Artist:
- Misrepresents qualifications
- Provides inaccurate information
- Fails to honour confirmed commitments
- Behaves unprofessionally
- Creates reputational risk
- Receives repeated negative client feedback
Section 10Use of name, image & branding
Showmaker may use an Artist's:
- Name
- Profile image
- Performance photographs
- Promotional materials
- Biography
for the purpose of:
- Talent discovery
- Client proposals
- Marketing materials
- Capability presentations
- Corporate recommendations
unless otherwise agreed in writing.
Showmaker shall not represent any Artist as exclusively signed, managed, or represented unless a separate written agreement expressly states otherwise.
Section 11Independent contractor relationship
Nothing in this Agreement creates:
- Employment
- Partnership
- Joint venture
- Agency relationship
between the Artist and Showmaker.
Artists remain independent contractors responsible for:
- Taxes
- Insurance
- Licences
- Statutory obligations
- Professional obligations
unless otherwise agreed in writing.
Section 12Legal compliance & indemnity
Artists confirm that:
- Submitted content is owned by them or properly licensed
- Materials do not infringe third-party rights
- Information supplied is accurate
Artists agree to indemnify and hold harmless Showmaker from claims arising from:
- Copyright infringement
- Misrepresentation
- Unauthorised use of content
- Breach of these Terms
to the fullest extent permitted by law.
Section 13Changes to these terms
Showmaker may update these Terms & Conditions from time to time.
Updated versions shall be published on this page and become effective upon publication.
Continued participation on the platform shall constitute acceptance of the revised Terms.
Section 14Governing law & jurisdiction
These Terms & Conditions shall be governed by the laws of India.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.
